Terms of Service

These Terms of Service ("Terms") govern your access to and use of PriceTrail (the "Service") operated by Michele Fasciano, trading as PriceTrail, a sole trader based in the United Kingdom ("PriceTrail", "we", "us"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy.

1. Account Eligibility and Registration

You must be at least 18 years old to create an account. By registering, you confirm that the information you provide is accurate and that you will keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not share your account or transfer it to another person without our prior written consent.

We offer sign-in via email/password or via Google (OAuth). If you use Google sign-in, Google's own terms and privacy policy apply to your use of that authentication service.

2. Acceptable Use

You may use the Service only for lawful personal or internal business purposes. You agree not to:

  • Violate any applicable law, regulation, or the terms of service of any website you track through the Service
  • Interfere with or disrupt the integrity, security, or performance of the Service or its infrastructure
  • Attempt to gain unauthorized access to the Service, its systems, or any other user's account
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to scrape, harvest, or collect data beyond the features we make available to you
  • Resell, redistribute, or sublicense access to the Service or any data obtained through it without our prior written permission
  • Use the Service in a way that infringes the intellectual property or other rights of any third party

We reserve the right to suspend or terminate accounts that we reasonably believe are in violation of this section.

3. Subscription Tiers and Billing

PriceTrail offers a 14-day free trial and paid subscription tiers (Seller, Operator, and Team). The features available on each tier are described on our pricing page. We reserve the right to modify tier features with reasonable prior notice.

Pro subscriptions are billed on a recurring basis (monthly or annual, as selected at checkout) via Stripe. Fees are charged in advance at the start of each billing period. By subscribing, you authorize us to charge your payment method on file for all recurring subscription fees until you cancel.

You may cancel your subscription at any time from the Settings page of your account. Cancellation takes effect at the end of the current billing period, and you will retain access to Pro features until that date.

4. Refund Policy

If you cancel your Pro subscription within 7 days of a billing charge, you may request a pro-rated refund for the unused portion of that billing period. To request a refund, email us at hi@pricetrail.co within 7 days of the charge with the subject line "Refund request". Refund requests made after 7 days are granted at our sole discretion, except where required by applicable law.

EU consumers: If you are a consumer in the EU and you purchased a Pro subscription within the last 14 days and have not yet used the Pro features, you may also have a statutory right of withdrawal — see Section 8 below.

5. Price Data Accuracy

PriceTrail collects publicly available pricing information from websites you choose to track. We make no guarantee as to the accuracy, completeness, or timeliness of this data, and prices displayed in the Service may differ from prices currently shown on the retailer's website. Always verify prices directly with the retailer before making a purchasing decision.

6. Intellectual Property

The Service, including its software, design, content, and trademarks, is owned by PriceTrail and protected by copyright and other intellectual property laws. These Terms do not grant you any ownership interest in the Service.

You retain ownership of any content you submit to the Service (such as product URLs or alert configurations). By submitting that content, you grant us a limited, non-exclusive, royalty-free license to use it solely to provide the Service to you.

If you provide feedback or suggestions about the Service, we may use that feedback without restriction or obligation to you.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

EU consumers: Nothing in this section limits or excludes your statutory rights under applicable consumer protection law. See Section 8.

8. EU Consumer Statutory Rights

If you are a consumer resident in the European Union or United Kingdom, these Terms do not limit or exclude any statutory rights you have under applicable consumer protection law, including:

  • Right of withdrawal: Under the EU Consumer Rights Directive (2011/83/EU), you have a 14-day right to withdraw from a distance contract without giving a reason. For digital services that you have expressly requested to start immediately, this right may be lost once supply has begun and you have acknowledged this in writing. If you subscribed to Pro and have not used any Pro features, contact us within 14 days of purchase to exercise this right.
  • Conformity guarantees: Digital services must conform to the contract. If the Service does not conform, you may be entitled to a remedy, a price reduction, or termination of the contract under applicable law.
  • Unfair contract terms: Any provision in these Terms that would be regarded as unfair under the EU Unfair Contract Terms Directive (93/13/EEC) or equivalent applicable law shall be unenforceable to that extent. The remaining Terms will continue in full force.

Nothing in these Terms is intended to limit rights that cannot be excluded or restricted under applicable mandatory consumer law.

9. Limitation of Liability

To the maximum extent permitted by applicable law, PriceTrail shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the greater of (a) £100 GBP, or (b) the total amount you paid to PriceTrail in the 3 months immediately preceding the event giving rise to the claim.

EU consumers: The limitations above do not apply to liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable mandatory consumer law.

10. Termination

You may stop using the Service and delete your account at any time from the Settings page. We may suspend or terminate your access to the Service if you materially violate these Terms, with or without prior notice depending on the severity of the violation. Upon termination, your right to use the Service ceases immediately. Sections 6, 7, 9, and 11 survive termination.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

If a dispute arises out of or in connection with these Terms, the parties will first attempt to resolve it by good faith negotiation. Either party may initiate this process by sending a written notice describing the dispute to the other party. If the dispute is not resolved within 30 days of that notice, either party may bring proceedings in the courts of England and Wales, which shall have exclusive jurisdiction, subject to the EU consumer rights preserved in Section 8.

EU consumers: If you are a consumer in the EU, you may also bring proceedings in the courts of your country of habitual residence, and you may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email to the address on your account and by posting a prominent notice in the Service at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service before the effective date.
